GOLF SIMULATOR FACILITY USE AGREEMENT, LIABILITY WAIVER & RELEASE

PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING AGREEMENT

By signing below, I acknowledge and agree to the following:

1. Assumption of Risk

I understand that participation in activities at [Your Business Name] involves inherent and significant risks of injury, including but not limited to:

  • Being struck by golf clubs or golf balls

  • Slips, trips, and falls

  • Equipment malfunction or misuse

  • Injuries caused by other participants

  • Risks associated with alcohol consumption

  • Risks associated with an unstaffed or 24/7 facility

I voluntarily and knowingly assume all risks, both known and unknown, even if arising from the negligence of [Business Name].

2. Release of Liability (INCLUDING NEGLIGENCE)

To the fullest extent permitted by Pennsylvania law, I hereby release, waive, and discharge [Business Name], its owners, members, employees, contractors, agents, and affiliates from any and all claims, demands, damages, rights of action, or causes of action arising from:

  • Personal injury, death, or property damage

  • Use of the facility or equipment

  • Actions or negligence of myself or others

  • Consumption of alcohol on the premises

This release specifically includes claims arising from the NEGLIGENCE of [Business Name], but does not apply to gross negligence or willful misconduct where prohibited by law.

3. BYOB Alcohol Policy & Responsibility

I acknowledge that this is a Bring Your Own Beverage (BYOB) facility and agree that:

  • I am 21 years of age or older if I consume alcohol

  • I will not provide alcohol to minors

  • I am solely responsible for my alcohol consumption and behavior

  • I understand that alcohol increases the risk of injury

I agree that [Business Name] is not responsible for any injury, damage, or incident related to alcohol consumption.

4. Rules & Safe Conduct

I agree to:

  • Use equipment only as intended

  • Swing clubs only in designated hitting areas

  • Remain aware of surroundings and other participants

  • Refrain from reckless, dangerous, or disruptive behavior

  • Follow all posted rules and instructions

I understand that failure to follow rules may result in removal without refund.

5. Responsibility for Damage

I agree to be financially responsible for any damage I cause to:

  • Golf simulator equipment

  • Facility property

  • Other guests’ property

I authorize [Business Name] to charge my card on file for damages if necessary.

6. Indemnification

I agree to indemnify, defend, and hold harmless [Business Name] from any claims, liabilities, damages, costs, or expenses (including attorney’s fees) arising from:

  • My actions or negligence

  • My guests or invitees

  • My violation of this agreement

7. Medical Treatment

I consent to receive emergency medical treatment if necessary and accept full responsibility for any associated costs.

8. Unstaffed Facility Acknowledgment

I understand that the facility may be unstaffed during my visit and that:

  • I am responsible for my own safety

  • I am responsible for the safety and conduct of my guests

  • Emergency services must be contacted by dialing 911 if needed

9. Surveillance & Security

I acknowledge that the premises may be monitored by video surveillance for safety and security purposes.

10. Severability

If any portion of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

11. Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania.

12. Acknowledgment of Understanding

I certify that:

  • I have read this agreement in full

  • I understand its contents

  • I am signing it voluntarily

  • I understand that I am giving up substantial legal rights
